If you are a User of the Engagement Suite and/or its Toolkits, please read the Privacy Policy carefully and make sure you fully understand it. You are not legally required to provide us with any of your Personal Data, and may do so (or avoid doing so) at your own free will. If you do not wish to provide us with your Personal Data or to have it processed by us or any of our services providers, please simply do not visit or interact with the Engagement Suite and/or its Toolkits.

Changes to this Privacy Policy. We reserve the right, at our discretion, to change this Privacy Policy at any time. Such change will be effective ten (10) days following posting of the revised Privacy Policy on the Engagement Suite, and your continued use of the Services thereafter means that you accept those changes.
Any uncapitalized terms used in this Policy shall have its meanings as given in the Engagement Suite Terms of Service.
1. Personal Data Collection & Legal Bases
In this notice “Personal Data" means any information that can uniquely identify a living individual, either alone or in combination with other information. This excludes information stored in a format that cannot reasonably be linked to an individual. We collect various categories of Personal Data in relation to the use cases mentioned earlier and your use of the Engagement Suite and/or its Toolkits. If you are a User subject to the European GDPR, we are deemed a “data controller” with respect to your Personal Data.
We use and collect the Personal Data on the following legal bases: for the provision of the Engagement Suite and/or its Toolkits (“performance of a contract”), to comply with our legal obligations (“legal obligations”), and to support, facilitate and improve the Engagement Suite and its Toolkits (“legitimate business interests”), all as further described below:
When you use or access the Engagement Suite and its Toolkits, we collect Personal Data about you. Some features of the Engagement Suite and certain Toolkits may require you to directly provide us with certain information about yourself. You may elect not to provide this information, but doing so may prevent you from using or accessing or enjoying certain functionalities of the Engagement Suite and Toolkits.
You may provide some or all of the following information to us when you visit and use the Engagement Suite, request access to and use certain Toolkits, sign up for our newsletters or alerts, or contact us via the Engagement Suite, social media or other support channels:
Basic contact details, such as full name and email address.
Account information, such as username. You are responsible for keeping your account credentials safe. We recommend you do not share your access details with anyone else. If you believe your account has been compromised, please contact us immediately.
Payment information, such as bank account, and billing address, which we collect using a third party payment processor.
User-generated content, such as text, notes, materials and other information submitted by you through certain Toolkits.
Any other information you choose to include in communications with us, for example, when sending us an email, interactions with our ads, or requesting more information about the Engagement Suite and/or its Toolkits.
2. Use of your Personal Data
We process your Personal Data in order to perform our contract with you, such as:
Providing you with the Engagement Suite and its Toolkits,
Register and maintain an account with us,
To communicate with you about our products, services, marketing, promotions, events and other news and information we think may be of interest to you.
In order to be responsive to you, to provide effective services to you and maintain our business relationship, as a matter of our legitimate interests, we will use your Personal Data:
Administer the Engagement Suite and its Toolkit and our internal operations, and conduct troubleshooting, testing, data analysis;
Maintain the safety and security of the Engagement Suite and its Toolkits;
Send you announcements in relation to security, privacy or administrative communications (these communications are not marketing-oriented);
Personalize your experience with the Engagement Suite and Toolkits;
Improve and develop the Engagement Suite and its Toolkits.
In addition, we will use some or all of the above information to comply with applicable legal obligations, to enforce our contractual arrangements and our policies, and to protect or defend the Engagement Suite and its Toolkits, our rights, the rights of our Users, or others.

4. Personal Data Location & Retention
Location. The Personal Data we collect from you will be accessed from, transferred to and stored and used by us, and our third party service providers, in the United States and Israel (recognized by the European Commission as offering adequate protection to individuals residing in EU member states), or other locations necessary for the provisioning of the Engagement Suite and its Toolkits, related services or legal compliance. We take reasonable steps to ensure your information is treated securely and in accordance with this Privacy Notice.
Retention. We retain your Personal Data until it is no longer necessary for the purposes it was collected or until you submit a valid data deletion request. In some cases, we may retain Personal Data longer:
To comply with our legal and/or regulatory requirements (including tax and accounting obligations);
As permitted by applicable data retention laws;
To resolve disputes;
If we reasonably anticipate legal action regarding your Personal Data;
To enforce our contractual agreements and policies;
To promote safety, security and integrity the Engagement Suite, its Toolkits, our rights, of our Users and of others.
5. Third Party Websites and Links
We may provide links to third-party websites or platforms. If you follow links to sites or platforms that we do not control and are not affiliated with us, you should review the applicable privacy notice, policies and other terms. We are not responsible for the privacy or security of, or information found on, these sites or platforms. Information you provide on public or semi-public venues, such as third-party social networking platforms, may also be viewable by other Users of the Engagement Suite and/or users of those third-party platforms without limitation as to its use. Our inclusion of such links does not, by itself, imply any endorsement of the content on such platforms or of their owners or operators.
6. Data Security
Despite our reasonable efforts to protect your Personal Data, no security measures are impenetrable, and we cannot guarantee “perfect security.” Any Personal Data or other information you send to us electronically, while using the Engagement Suite and/or its Toolkits, or otherwise interacting with us, may not be secure while in transit. We recommend that you do not use unsecure channels to send us sensitive or confidential information.
7. Your Privacy Rights
If you wish to exercise your privacy rights available under applicable data privacy laws (including, the European GDPR or CCPA) in connection with your Personal Data we retain - such as the rights to access, portability, correction, erasure, restriction of processing to storage only, objection to processing, objection to marketing, right to non-discrimination - you may do so by emailing [email protected].
Your email should include adequate details of your request. If you are a User to whom the European GDPR applies, you may also lodge a complaint with a supervisory authority. We will respond to requests to exercise these rights without undue delay and at least within one month (though this may be extended by a further two months in certain circumstances).
Please note that a number of these rights only apply in certain circumstances, and all of these rights may be limited by law. For example, where fulfilling your request would adversely affect other individuals, our trade secrets or intellectual property, where there are overriding public interests or where we are required by law to retain your personal data.
We may request information to reasonably verify your identity prior to fulfilling the request. In addition, we may ask you to use the self-serve features available on the Website in order for you to fulfill the request independently within your User Profile.
CCPA Requirements: The CCPA, affords our Users who are California residents the right to opt-out of the “sale” or “sharing” of their Personal Information (as defined in the CCPA). We do not “sell” or “share” your Personal Information for the purposes of the CCPA. We do share and disclose your Personal Information to authorized third parties as described in Section 3 above. 8. Use by children
The Engagement Suite and its Toolkits are not intended for children. If you are under the age of 18, you may not use the Engagement Suite and/or its Toolkits, or provide any information on the Engagement Suite and/or its Toolkits without involvement of a parent or a guardian. We do not knowingly collect information from, and/or about children.
